Terms and Conditions of Sale

Article 1 — Purpose

These General Terms and Conditions of Sale (GTC) govern the sales of products concluded on padel-essentials.com between PADEL ESSENTIALS LLC ("the Seller") and any non-professional buyer ("the Customer"). Any order implies unreserved acceptance of these GTC.

Article 2 — Products

The products offered are padel rackets and associated accessories, within the limits of available stock. Photographs and descriptions are provided for informational purposes only.

Article 3 — Prices

Prices are indicated in euros. The total amount due, including delivery costs if applicable, is displayed before the order is validated. The Seller reserves the right to modify its prices at any time; the applicable price is the one in effect at the time of the order.

Article 4 — Order

The Customer selects their products, checks the details of their order, then validates it after accepting these GTC. The sale is firm upon confirmation of the order and receipt of payment.

Article 5 — Payment

Payment is made online by credit card via a secure payment provider. The order is processed only after payment confirmation. Banking data is never stored by the Seller.

Article 6 — Delivery

Delivery terms, times, and costs are detailed in our Delivery Policy: Metropolitan France 9 to 12 working days (Colissimo, free from €100 purchase); French overseas departments and territories 10 to 15 working days (price according to destination). Deadlines run from the date of dispatch. In the event of unjustified delay, the Customer may, after formal notice that remains without effect, cancel the order and be reimbursed (Article L216-1 et seq. of the Consumer Code).

Article 7 — Right of Withdrawal

In accordance with Articles L221-18 et seq. of the Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without justification.

To exercise it, the Customer informs the Seller of their decision by an unambiguous declaration (e-mail to padelesentials@gmail.com). The product must be returned in its original, unused condition, with its packaging, within 14 days following the communication of the decision.

Return costs are borne by the Seller: a prepaid shipping label, accompanied by the return address, is provided to the Customer after acceptance of their request.

The Seller refunds all sums paid, including standard delivery costs, no later than 14 days after being informed of the withdrawal (reimbursement may be deferred until the product is recovered).

Article 8 — Legal Guarantees

The Seller remains bound by the legal guarantee of conformity (Article L217-3 et seq. of the Consumer Code, 2 years) and the guarantee against hidden defects (Article 1641 et seq. of the Civil Code). Implementation: padelesentials@gmail.com.

Article 9 — Liability

The Seller cannot be held responsible in case of force majeure or an unforeseeable and insurmountable act of a third party.

Article 10 — Personal Data

The data collected is processed in accordance with our Privacy Policy and the GDPR.

Article 11 — Consumer Mediation

In accordance with Article L612-1 of the Consumer Code, the Customer has the right to free recourse to a consumer mediator for the amicable resolution of a dispute. The Customer may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

Article 12 — Applicable Law

These GTC are subject to French law for any Customer residing in France, who benefits from the protection of the mandatory provisions of their country of residence. Failing an amicable resolution, the competent French courts may be seized.
